PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE PUMPING MARVELLOUS FOUNDATION CARDIAC REHABILITATION COURSES ("platform"). WHEN YOU INDICATE YOUR AGREEMENT TO THESE TERMS ON OUR WEB PLATFORM, THEY WILL FORM A BINDING AGREEMENT BETWEEN US.

1. What's in these terms?
These terms outline the rules for using our online Cardiac Rehabilitation course platform https://university.pumpingmarvellous.org/account/login
2. Who we are and how to contact us
The Cardiac Rehabilitation courses are owned by the Pumping Marvellous Foundation ("we", “us” etc.). We are registered in England and Wales under company number 08370761 and have our registered office at:

3. By using our platform, you accept these terms
By using our platform, you confirm that you accept these terms of use and agree to comply with them.
You must indicate your agreement to these terms to create a user account on our platform, at which point these terms will form a binding contract between us. You must not use our platform if you disagree with these terms.
You must be aged 18 or over in order to create a user account on our platform.
We recommend that you save a copy of these terms for future reference.
4. There are other terms that may apply to you
These terms apply to all users of our platform.
In addition to these terms, the following policies apply to your use of our platform (please note that these policies are intended to provide you with information; they do not form a contract between us):

5. We may make changes to these terms
We may amend these terms from time to time. Please check these terms to ensure you understand the terms that apply at that time. We will notify you of any significant changes to these terms on the Pumping Marvellous platform or by email at the address you provide when you register your account. These terms were most recently updated on 31st May 2024.
6. We may suspend or withdraw our platform
We do not guarantee that our platform or any content will always be available or uninterrupted. We may occasionally update and change our platform to reflect changes to our service and users' needs. We may also suspend, withdraw or restrict the availability of all or any part of our platform for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal or any major changes to our platform. We will notify this on this platform and www.pumpingmarvellous.org along with all email addresses used at point of registration.
7. You must keep your account details safe
If you choose, or you are provided with, a user identification, password, or any other piece of information as part of our security procedures, you must treat such information as confidential. Your responsibility is to keep your user information confidential and comply with the terms and conditions.
We have the right to disable any user identification or password, whether chosen by you or allocated by us, at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these terms of use.
If you know or suspect that your user identification or password has been compromised, you must promptly notify us at hearts@pumpingmarvellous.org
8. You must provide accurate information
You must ensure that any information you provide regarding your account on our platform is accurate to the best of your knowledge.
This includes your username, contact details, and other personal information, including a brief medical overview, that you provide to us to create your account.
9. How you may use material on our platform
This clause applies to any material published on our platform,
We are the owner or the licensee of all intellectual property rights in our platform and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
- You may print/download information from our platform for your personal use.
- You must not modify the paper or digital copies of any materials other than where indicated in completable forms
- Our status (and that of any identified contributors) as the authors of content on our platform must always be acknowledged.
- You must not use any part of the content on our platform for commercial purposes without obtaining a license to do so from us or our licensors.
- If you print off, copy or download any part of our platform in breach of these terms of use, your right to use our platform will cease immediately, and you must, at our option, return or destroy any copies of the materials you have made.
10. Do not rely on information on this platform
The content on our platform is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking or refraining from any action on the basis of the content on our platform.
Although we make reasonable efforts to update the information on our platform, we make no representations, warranties or guarantees, whether express or implied, that the content on our platform is accurate, complete or up to date.
11. We are not responsible for websites we link to
Where our platform contains links to other resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those platforms or resources.
12. User-generated content is not approved by us
This platform may include information/feedback uploaded by other platform users and any information or comments posted on our forums. We have not verified or approved this information or these materials. The views expressed by other users on our platform do not represent our views or values.

13. Our responsibility for loss or damage suffered by you
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- use of, or inability to use, our platform; or
- use of or reliance on any content displayed on our platform.
- loss of profits, sales, business, or revenue.
- business interruption.
- loss of anticipated savings
- loss of business opportunity, goodwill, or reputation
- or any indirect or consequential
If you are a user, please note that we only provide our platform for your domestic and private use, subject to your accepting our Terms and Conditions and having authorisation from qualified healthcare professionals confirming your suitability to exercise. You agree not to use our platform for any commercial or business purposes, and we have no liability to you for any loss of profit, business
interruption, or business opportunity.
14. How we may use your personal information
We are the controller of the personal data you provide us through our platform, including when you create your user account. Our GDPR & Privacy Policy (available at https://pumpingmarvellous.org/privacy-policy/)explains how we use your personal data, and we will only use your information in accordance with that policy.
To make cardiac rehabilitation for heart failure more accessible, we will share your pseudonymised data with the NHS to feed into their annual Cardiac Rehabilitation Audit. 15. Acceptable use of our platform
You may use our platform only for lawful purposes. You may not use our platform:
- in any way that breaches any applicable local, national or international law or regulation
- in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect
- for the purpose of harming or attempting to harm minors in any way.
- to bully, insult, intimidate or humiliate any person.
- to send, knowingly receive, upload, download, use or re-use any material which does not comply with our terms and conditions.
- to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional
- material or any other form of similar solicitation (spam); or
- to knowingly transmit any data, send or upload any material that contains viruses, trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
You also agree:
- not to reproduce, duplicate, copy or re-sell any part of our platform in contravention of these terms; and
- not to access without authority, interfere with, damage or disrupt any part of our platform; any equipment or network on which our platform is stored; any software used in the provision of our platform; or any equipment or network or software owned or used by any third party.
We reserve the right to take such action as we deem appropriate if we consider that you have breached these terms of acceptable use or any other provision of these Terms of Use. Such action may include:
- immediate, temporary or permanent withdrawal of your right to use our platform
- legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach
- further legal action against you and
- disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
We exclude our liability for all actions we may take in response to breaches of these Terms of Use.
Our actions are not limited to those described above; we may take any other action we reasonably deem appropriate.
16. Interactive Services
We may occasionally provide interactive services on our platform, including, without limitation, messaging facilities and forums.
Where we provide any interactive service, we will clearly inform you about the kind of service offered, whether it is moderated, and what form of moderation is used (whether human or technical).
We will do our best to assess any possible risks for users from third parties when they use any interactive service provided on our platform, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our platform, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.
Where we moderate an interactive service, we normally provide you with a means of contacting the moderator should any concerns arise.
17. We are not responsible for viruses, and you must not introduce them
We do not guarantee that our platform will be secure or free from bugs or viruses.
- you are responsible for configuring your information technology, computer programs and platform to access our platform.
- you should use your own virus protection software.
- you must not misuse our platform by knowingly introducing viruses, trojans, worms, logic bombs or other malicious or technologically harmful material.
- you must not attempt to gain unauthorised access to our platform, the server on which our platform is stored or any server, computer or database connected to our platform.
- you must not attack our platform via a denial-of-service or distributed denial-of-service attack.
You would commit a criminal offence under the Computer Misuse Act 1990 by breaching this provision.
We will report any such breach to the relevant law enforcement authorities and cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our platform will cease immediately.
18. Rules about linking to our platform
You may link to our home page, provided you do so in a fair and legal manner and do not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part where none exists.
You must not establish a link to our platform on any platform that you do not own.
Our platform must not be framed on any other platform, and you may not create a link to any part of it other than the home page.
We reserve the right to withdraw linking permission without notice.

19. We may transfer this agreement to someone else
We may transfer our rights and obligations under these terms to another organisation. If this happens, we will always tell you in writing and ensure that the transfer will not affect your rights under the contract. We will notify this on this platform and www.pumpingmarvellous.org along with all email addresses used at point of registration.
20. Which country's laws apply to any disputes?
Please note that these terms of use, their subject matter and their formation are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland. If you are a resident of Scotland, you may also bring proceedings in Scotland.
Pumping Marvellous Foundation's Cardiac Rehabilitation Courses and its intellectual property is owned by Pumping Marvellous Foundation, registered in England and Wales, registered company number 08370761, registered with the Charity Commission for England and Wales, registered charity number 1151848.
